Advice NEEDED - OIL Tank leaking and Landlord shrugging off My OIL LOSS ??

Hi ya, Hoping some of mylotters can give some advice cause I sure need it today! Woke to a freezing house, okay not freezing but 58 degrees is way too cold.. So go to check thermostat and find the furnace isn't working. Hmmm. Got a full tank of Oil on November 30th and that should have lasted us til at least the end of Feb. We regularly go a full season on 1 tank so this is very odd. Our furnace had been checked and serviced in late December so it's not the issue.
Ah...now here's where it gets interesting. Originally, the oil guy came to fill it on Nov 25th and said the tank was leaking and needed to be checked. He left a note and didn't add any new fuel. We weren't out so it wasn't a huge issue then. So I called the landlord and he came over and checked it and said it was fine. So we filled it on November 30th.
Since I have a bad back, I called a friend to come and check on it, he looked at it and tells me I have a MASSIVE leak and there's lots of oil all over the ground. And to prove it to me, he got a rag and dipped it in the puddle and brought it so I could sniff it. YUP..that's oil alright!
So I call the Landlord and review it with him, he says he'll arrange to check on it and can get a new tank if needed. I say that's great and how long will that take, he says he's not sure as he'll need to make some calls. Hmm..so then I ask what about the oil loss? No response. So I nicely press abit more saying that if the oil leaked after he assured me the tank was fine and no leaks, then they should help me with the refill since I wouldn't have filled a tank if I knew it had a leak!! No response.
Then he says he's going to start on the calls about the tank as soon as either he or the handy man comes to check it out and sees that it does need to be replaced. Then goodbye and click...
We've lived here for over 4 years and have never had any issues except the Oct robbery when they had to repair the doors and that had nothing to do with us as far as liability goes. The 2 doors were kicked in when locked so no issue there. We always pay on time and have been very friendly now an issue comes up and it's like well...let's check the tank and replace it if need be but nothing about my loss of oil = money from his assurance the tank was good to go.
I'm really upset here and my beloved is out of town til next week so ANY advice would help. It sure is lousy that it's a friday since I think he's gonna delay things til next week. And it's only gonna get colder in here. We do have a fireplace and I am about to go start a blazing one!!
Any advice would be very much appreciated !!

You have a bigger issue than the lost fuel. The EPA could come in and make you move if he does not get the problem fixed. My uncle had an underground fuel tank that was leaking, he had to have the tank dug out and half of his backyard dug up to remove all the spilled oil removed. They then had to take the soil out and have it steralized, more dirt brought in to fill the whole and new seeding done.
Try using that information as your bargining chip.

Well, your landlord is negligent for sure. When he came and looked at it, you should have, too. The oil guy wouldn't have said it had a leak if it didn't. And apparently, HE was right, wasn't he? Figure out how much you paid for the oil, and how many days it usually lasts you and how many days you were short, and deduct that from your next rent cheque, AFTER he fixes the tank so you can fill it. Also, he should be paying for another heat source while you are out of fuel and cold. Get a FIRE going under his butt straight away, I say. This is urgent and you can't be without heat. This is HIS immediate responsibility to you as a good paying tenant.
