Supreme Court "evading the issue?"

According to Supreme Court Justice Clarence Thomas, the Supreme Court is evading the issue of ruling on whether one who is born outside the USA can be president. Why would they evad this issue? Why not simply do their jobs and uphold the Constitution?

You are the second person here on MyLot that has fallen for this story. Clarence Thomas is speaking to Subcommittee Chairman Rep. Jose Serrano, D-N.Y. Serrano asks Thomas "I'm still waiting for the [court decision] on whether or not a Puerto Rican can run for president of the United States." Thomas evaded that question. Puerto Rico is apart of the USA but has the status of a commonwealth. There is no reason for the court to decide on a subject that has never come up.

I don't think I have "fallen" for anything. Thomas said he is evading the question. It came up, and he made a joke about it.

We are evading that issue was a joke. You even pointed out the joke. I believe that this was just banter between the two men. They really are not evading the issue. There is a case scheduled June 29th. They will not be able to evade it then.

It might actually be a good idea to evade issues that may come up later, to keep from muddying the waters with conjecture beforehand and keep them focused.

I would imagine the question that needs to be regarded is whether or not one born in a territory of the U.S., possibly to American parents, is eligible to run for the president. For example, it was decided last election that even though McCain was born in Panama, because it was on an army base to two Americans, he was eligible to be elected.

They are evading the issue because there hasn't been a case brought to them that has any merit. A case was brought to them after the election, and all of the conservatives on the bench DECLINED to proceed. It wasn't even a party line vote either. Thomas himself said that there wasn't merit there.
