Can Facebook claim ownership over our personal pictures?

Facebook launches their popular disclaimer 3 months ago... this message is popped every time we upload photos, that Facebook enjoys the right to do whatever they wish with the photos being uploaded.. Is this a disclaimer? This phrase caused a lot of kudos among the web goers in this social networking site protesting to this clause as an invasion of privacy. What do you think about the disclaimer of facebook? Do you think its fair enough?
