duh! He can't sign it because he's disabled!!

I have been going around and around with my son's school loan people. He has tons of them!! I tell them he was in an automobile accident two years ago and has a tbi. They can't talk to me since I don't have power of attorney. They send me these papers for HIM to sign... that state he has been totally disabled... I'm like -- look you moron, he has a brain injury,,, if he could sign the papers he could grant power of attorney!!! sheesh!!! Sorry for the rant but I am to the max on this one... I called a lawyer.. who wants 150 bucks to tell me if he can help me or not!

If you aren't able to get someone to help you get the power of attorney for him, if you are able to get a pen into his hand and help him to write an X that should do it as well. When my grandmother was alive her writing got so shaky that she couldn't sign her name anymore, but my mother was told that if she was able to write an X then it was as good as signing her name herself. I certainly hope that you were able to get this all straightened up.

Actually, we just got that done just as you said this last week. I have power of attorney now and will be able to start tackling some of the schoolloan stuff for him! thanks!

Perhaps making a 100 calls to attorney's may get you someone who will take this on probate. It will not be easy but check the legal aid in your town and put in as an emergency situation. Good luck my heart aches for you as I have $140K student loans that I just can't pay and am being harassed to the tilt so your situation deserves a true blessing.

yeah, I checked with legal aid.. first they told me that guardianship would not do me any good. That only puts me in charge of his money, I already have that since I am the payee for his SSI. Then they sent me an application for guardianship procedures. then in a week they sent me some big detailed thing about my divorce! Incompetence!!! I don't think I want them taking my case at all!

Call a different lawyer. I am sure it can be done so that you can take care of things. Not all of them charge like that.

That's what I was thinking. I scheduled the appointment for Friday to give me some time to do some more research and cancel if I need to!
