rear ended, whose fault? - causing an accident on the road

I just raised a discussion about having car trouble on my way to work. So as I was standing beside my van, with lights flashing, and all cars trying to slow down to avoid me, I heard a loud crash. As it turns out, a pick up truck who slowed down behind my van was rear-ended by an SUV. Thankfully both drivers were alright, but I stood there while they began arguing on whose fault it was. The pick up driver kept pointing at me, as if to say it wasn’t his fault that he stopped. That it was in fact my fault for being in the middle of the road. Have you ever been in this situation? Would you agree with the pick up driver that it was my fault? I was already having a bad day, and didn’t think that this drama was a necessary addition on top of my woes. Wouldn’t you think it was the SUV driver’s fault for not stepping on the brakes in time? Do you leave a good space between you and the car in front, while driving for instances just as this?

I agree it's the SUV driver's fault for not braking and following too closely. What a shame! Everyone always wants someone else to blame. Sorry you had to go through this.

I don't know either.. maybe he just didn't want to start a fight with the SUV driver.. did he look big and scary? LOL

On the contrary, the SUV driver looked a bit tired. He might have just come from a late night shift at work. Could have been the reason too why he wasn't able to step on the brake on time.

The thing is, I didn't know why the pick up driver would still insist that it was my fault, because it was clearly the SUV driver's fault. Because he didn't leave enough space. Thanks.

The way it usually works is the person who rear ended the other guy is the one at fault. It doesnt matter why the guy in front of him was stopped he needs to pay close enough attention that he doesnt hit the driver in front of him. I feel terrible for you having to stand there like that with people mad at you when it wasent your fault you broke down. How embarrassing. The insurance company of those two men will sort out whose fault it is and dont let it worry you any. You breaking down was bad enough without having to deal with that as well. Thankfully no I have never had anything like this happen to me. I am glad that YOU werent hit while standing alongside the rode. My exes cousin broke down on the highway on foggy night and was walking to the next exit he was hit by a car and killed. That was very trumatic for his family. He wasent very old maybe 25 at the most. He was an amazing person. Imagine being the one who hit him how horrible they must have felt.

Exactly. You're supposed to drive so you avoid obstructions. What if a kiddy trips up crossing the road? "Duh - it was the kid's fault for being there?" The van had its hazard lights on and was stationary. Let the others sort it out - the worst you can say is, he may be called as witness to the accident. Anyone who tries to blame him for this is just digging a bigger hole for themselves.

How terrible shaggin! About your ex's cousin. How sad for his family that he should die needlessly. I even feel sorry for the driver that hit him (if it was really an accident), as he or she must be carrying that needless guilt all the time. Right jazzsue58. I think the pick up driver was not aware that it really wasn't her fault. The SUV driver should have left space in front. So there was no need to blame poor lil 'ol me.

People are supposed to leave enough room between them and the person in front of them for occasions such as this. There is always the chance of an emergency and it's just common sense to leave space to stop. It wasn't your fault.

I think they also came up to the same conclusion. After a few minutes of arguing, they did pull inside a curb and then I saw them exchange insurance information. They didn't even bother to talk to me anymore. Which is a good thing. Thanks Jen.

I think it is the SUV driver's fault....h didn't have total control over his vehicle... hence he drove into the back of the van. I am sure this driver will be put at fault. I try to keep a safe distance from the cars ahead of me.....but once in a while, I get behind a very slow driver and think if we ride his a$$, he will rive faster.. WTH??? LOL

You see that's the thing, if I was driving slow, and somebody would drive my a$$, I would get the message. And I would either drive faster or get out of the way. But some people don't get the message. Still, a safe distance is the way to go. Thanks.

hello, Oh my,that was terrible then. And,for whose fault it is,well, both drivers maybe. Being a driver, one must know that there is always a space in between,or should know the right distance in between. And,not to forget to give a warning when speed gets slower. That was really bad day to think of,but do not blame yourself,no one wishes to be stuck in the middle of the road with glaring stares and hearing bad words from other commuters huh. Take a deep breath and keep your cool

I guess for some countries, and for some cultures, accidents are even worse than what we see here. Specially if a lot of people don't obey traffic rules. Drivers and pedestrians alike. Thanks for the response.

Oh dear Bounce58 once again, I´m so sorry to hear that you were stressed today. Don´t worry, it´s not your fault, you were standed there with flashlights, and all things to prevent an accident... Isn´t it? So... this is not your fault that the driver was snoopying in other way, that he didn´t stop on time... So? The crash is his business, not yours! Blessings!... Dainy

Yes they did to that conclusion, as they never did come to talk to me. I think it was just the initial shock of getting a fender bender that they started to point at me to say that it was my fault. But after a few minutes, they did figure it out for themselves. And that I don't need to be in their conversation. Thanks.

Hello, As you were standing with your car's light flushing I do not think it was your fault as the accident took place. Surely it was the SUV driver who could not put break on time.

Hello krajibg. I think they came up with the same conclusion. That they should have enough space in front to have enough breaking speed. Thanks.

Glad to hear you did not get hurt and or hit from behind. The law here says anyone hitting from behind is at fault not the person in front, as according to our driving laws, we are suppose to allow enough room in front of us so that if there is a need to suddenly stop we can do so safely. I suppose the driver was upset but really it was not your fault at all as how can you predict that your car halted would cause an accident. It is not like you floored all of sudden causing him to abruptly stop. Even if that was the case how can it be your fault when you when the drivers behind you are suppose to watch and allow enough room. Had you been a school bus driver with children inside would the drive acted the same way, in fact they would all behind you be in trouble. I have not had a situation like yours but for some odd reason I have been hit while waiting at stop lights and or stop signs, something about the back of my cars that act like magnets while I am put. lol

I have a friend just like you! His car seems to attract bumpers. He always gets hit from behind. Nothing really hard that could cause whiplash, but enough to feel it. It also happens when he is at a stop light, or even when he is just parked. And sometimes the other driver is no where to be found when he realizes the damage. Thanks.

Of course there people who doesn't want to get the blame. For me it sounds ridiculous that the pick-up driver still put the blame on you having seen that your car was in trouble already. And you are right that we must leave good spacing between the car in front so that we can see better what's up ahead the road and avoid accidents like this. Well let the police handle it and for sure they will found out who's fault really it is. Good thing that all of you are alright.

Actually, they didn't wait for the police anymore. I guess between the two of them, they realized who was at fault. And they knew that their insurance would come up with the same conclusion. They never even bothered to come to me before they drove away. Thanks sais06.

Don't stress if you all have insurance let them figure it out it is not your fault you were broke down or what happened behind you. That is my best advice. My thoughts are with you.

Thanks soapies. Yes, it looked like they all had insurance. Because after a few minutes of arguing, they finally pulled in a side road. And then I saw them exchange information which I assumed to be for their insurance claims. I think they came to realize that it wasn't my fault because they never approached me.
