I don't understand my parnter and his ex-wife.....

Well it's actually a very long story so I have to summarize it.Way back 2008 before I met my partner now his ex-wife filed a divorce,went to German office social system and then told the office she wants to leave his husband and she needs room and back up.My partner or her ex-husband didn't knew that she filed divorced,he knew it after the government send papers that his wife file divorce,Now they separated and in German law,you need at least 1 year separation to continue the divorce process,I met him after 3 months and the first day he told me his situation and I did understand that.After one year waiting for the separation,my partner file a divorce last 2010 February and by May 31,his taxes are all in single status however the her ex wife did no participate during the process and the divorce case went on stocking up as she is not sending the complete calculation of pension in her side.The Judge as well the lawyer already sent her 3 major warnings that if the paper will be not send this April 2011,(The judge sent the papers last 3 weeks ago)Then she will pay 25 thousand euros or go to Jail for 6 months as she gives huge damage to the government.It's pretty obvious that she's not really listening to the Judge and how much more to his ex-husband? Now the divorce case is running for 3 years and still waiting for the final hearing. I don't know it will run but seems very complicated for me already.Don't wanna leave him since he takes care of me and the only problem is this thing.I just don't also understand why the judge don't have the power to force the other party.(LOL IF THERE'S A LAWYER HERE IN MYLOT SPECIALIZING DIVORCE,that will be a big help. Thanks.

It is kinda crazy how long these types of procedings can carry on if one party isn't helping them move along! My friend is in a similar situation with her husband. It looks like it will finally be done next month but he has dragged his feet like crazy.There are ways to go ahead and get divorced I understand. There needs to be as it's not fair to drag your feet and keep somebody bound up for all those years...

I also simply understand them,they were together 7 years boyfriend and girlfriend and then married for 3 years then divorce,I am not from western part and in my country divorce is not possible.The bad thing is there's no strong grounds for the divorce however they are separated for two years running 3 which means in German law,it's no reason to stay together.I just know that before they get married,his ex-wife cheated.

Hi macdingolinger and insulin: I don't know anything about Germand legislation but I think that your partners need to accept that this relationship is over. It's hard I know but the more she waits the more pain she'll feel in the end of the day. ALVARO

Well, first of all, a lawyer (or a doctor) doesn't have time for silly websites... And you would probably need a GERMAN lawyer to figure out what is needed. I do agree that the judge should be able to finish the divorce even without her cooperation do to abandonment - does your partner know where she's at? If she goes to jail, that means he can get all the paperwork signed I'd guess.
