I Have Just Filed A Lawsuit Against My Previous University

No joke, I just did it yesterday. :D I put a smiley but the truth is I am so nervous about it. So here's why I did it. I was a first year college back then when I had no choice but to stop from schooling because of money and I also had some personal issues before. I decided to work first so I can save money for my education but the university where I studied (take note, it's a big, famous and one of expensive universities in the Philippines) doesn't want to release my Transcript of records, instead they just gave me a scholastic record (kinda like a transcript) stating the purpose is only for my work and not for transfer of school. Remmember my first ever discussion here in Mylot about going back to college? I am now trying to go back and be a working a student. I have to transfer to another university near my office and home for convinience but my previous university refused to give me my credentials such as (transcript of records, good moral cert, honorable dismissal, etc.) Those are the most important requirements by the university where I will be transferring. So I've decided to fight for my right to education and went to our Commission on Higher Education to file a lawsuit against them. I don't want to cause any harm or damage to their name and reputation, all I want are my credentials necessary for my education. Wish me luck! ;)

You deserve to get your records. That University just wants to keep you as a student and wants you to pay the traveling costs to go from your work to their university. So I hope you succeed.

I am not special either. And I would think that if I went to a university and they were selfish, I would think the whole administration was crazy.

Thank you suspenseful! :) This is going to be like the suspense part of my life. lol Unfortunately there are some universities who are so selfish. I'm just wondering though. What do they want from me? I was just an average student, not genius, no extraordinary talent and I haven't brought any awards and recognition for that school. In other words, I am a nobody so why hold me? Haha! I don't think the profit they could possibly get from my tuition fee will be a big loss to their business if they let me out. :)

Hi xsparky! I guess they don't want you to transfer to another school. But I don't really see the point why they don't want to give you your TOR when it is your right to have a copy of it. It's really annoying when someone or something bullies you and deprived you of your right to move on. I commend you for your guts to go to CHED and bring the matter to them. If I was your friend, I mean, your friend in real life, I will support you one hundred percent. These kinds of schools should be taught a lesson. Good luck!!!!

Thanks secretbear! :) That's exactly what I'm also thinking but why on earth would they hinder me for doing such move. It is my right to choose where to study and everybody has the freedom to choose. CHED is the only thing I got or maybe I can ask for the help of media too. Just like making a big alarming scandal. lol

Every student is like a treasure. Because they pay huge tuition fees! Oh, I think getting the media involved is not a good idea. Maybe as a last resort? Just to teach your old school a lesson. But be sure you're on the right side first before going to the media, and be sure to have all the facts.

Thanks jillhill! Yeah it bothers me for hmmm... I guess three years now. I have to think of it over and over again and consider all the possibilities before I've made my decision with the help of my legal advisor.

Hi Xparky: I think it's sad that you have to lawsuit your university to get your documents and your personal information. It's not right so even if we would love to get out of a university just thinking about the good experiences we had there, you have the right to fight for this because they are playing with your future. good luck, hope everything will be ok in the end. Thanks Alvaro! It is really sad to sue my old school. I've made friends there, professors who are so good and some employees who are so approachable but they are messing up with my plans of pursuing my education. Sorrow... :(

It should be a matter of course and obligatory for the school to give you these papers as it is your fundamental right to have them. These papers are so basic to your person; without them, you had be less than Xsparky017. The right to the security of a person and of his/her papers is likewise guaranteed by the Philippine Constitution. Denying you these papers constitutes a gross violation of this very basic human and Constitutional right. Did you include in your petition to CHED a claim for damages against the school and a plea to discipline the school's administration?
