does both have to sign

I have a friend that is wanting to get a divorce from her husband they have not been together in over ten years and right now he is in jail and he told some people that he would not sign the papers and I was trying to find out for her if both need to sign the papers or can she still get a divorce since he is in jail. The conditions to be met for a divorce as they said, varies according to countries and states. Some places would only require the signature of one person and as long as they have lived separately for over a year, the divorce is considered final. Anyway, it is best for you to go to an attorney to have a full understanding of the conditions of divorce at your place.

It is very likely that I could be wrong, but I am pretty sure that in the state of Kentucky that both parties in a divorce have to sign the paperwork in order for the divorce to be finalized. The reason that I think that this is the case is because of the fact that my best friend has been wanting to get divorced from her estranged husband so that she is able to move on with her life. However, he refuses to sign for a divorce because that will mean that he will lose all rights to her son because the little boy is not her husband's biological child.
