Strict Company Rules

My sister in law works as an HR staff in a known chains of hypermarkets in the country. She told me how strict their company is in terms of their rules and regulations. She told me an incident about a guy who works as a sales clerk who brought his own ballpen inside the selling area and has been imprisoned for that. They say that the guy should have informed the security to put a sticker on his ballpen so that they will know that it is indeed his ballpen. Another incident was when an IT staff took a piece of chocolate worth fifty one pesos early in ther morning and planned to pay for it when the first available cashier arrived. She was charged of qualified theft and has been imprisoned twice already after she was not informed of the date of the hearing of her case. When I think about those incidents, I can't help but think that their management is too much. Maybe it would be more humane if they would just terminate those employees and let them pay ten times or even hundred times of the amount of the item. To be imprisoned for just a piece of ballpen or a chocolate is kind of hard for me to accept. Jail is such a dangerous place. Or am I wrong? What is your view/opinion about it?

wow ! that was just so harsh.. they didn't even have a warning or disciplinary action within company alone first ? they are over reacting!

That was actually my first reaction when I heard about those cases. It is hard to believe but it is really happening. She even told me an incident where an employee ate a piece of pineapple and was charged of qualified theft as well. It is sad that the management no longer communicate with the employee after they were caught of doing those. They don't talk to their employees and just let the security bring them to the police and file a case. I have never known such company as that. I believe that their HR department should handle the case first. I would understand if the employee rob their cashier or sneak in the store in the middle of the night and took items from there. But those cases I have mentioned, I believe that they should have settled those with them alone. No need to call the attention of the police. I think that to be humiliated, terminated and pay high for such action is enough as punishment. They don't have to bring them to the police and ruin their future.

You are right. I think they are going way overboard specially since those were accidents which didn't really harm anyone. Having a criminal record will make a person have difficulty in finding another job. I truly think that company has issues.

That is so true. It can really affect the future of those employees. Most companies will ask for clearances and if they found out on their records about the past incidents, they won't be accepted for sure. I didn't know that those kind of rules are being implemented by some companies. I am happy that my company don't do such thing to us. If some have committed mistakes, or did not follow a rule, he would be sent to the HR office to be given a chance to explain. If the case is unforgivable, the worst they can do is to force someone to render resignation or to terminate him. I have heard more sensitive cases in our office but none of them was imprisoned.

Hi Paper_Doll, I agree with you. I worked in a different supermarket for 5 years and the rules and regulations are very strict and never attempt to break those rules and regulations because of their heavy punishment. Also i think it depends on the HR management and general/branch manager if she/he going to execute the proper punishment or not. I remembered when I was working as a cashier in SM supermarket 8 years ago, one of our cashier forgot to surrendered the tip that was given to her by the customer in customer service and she did not realized that still holding it until she arrived in the frisking area where the security guards discovered it. She has been asked to stay in the holding area for questioning and when they found out its an intentional mistake instead of calling the police the HR manager and General/Branch manager decided to asked the cashier to write a resignation letter and she will not going to receive her last salary including 13th month pay and got black listed to all SM malls. I think that was much better than going to jail because of an unintentional mistake.

It is good to know that their HR manager still talked to that cashier instead of bringing her to the police station. Forcing her to resign is much better than filing a criminal complaint against her. It is good to know that their HR Manager and Branch Manager still have the heart. Qualified theft is quite overwhelming to think that it was a tip which was given by a customer for HER good service. I think that SM management is far better than this company I am referring to. They did not even give a chance to their employees to talk to the management, make them finished their job so they have the time to process the papers for the case and sent them to the barangay post then police station. I am so disappointed when I learned about those incidents because we all know that being in jail is very dangerous. You even risk your own life and future in there. Some are being raped and hurt both physically and mentally. I am thinking if this supermarket has thought of about that before filing a complaint. Everybody deserves a second a chance. If this is the first time it happened, I don't think it is fair enough to just put her in jail. I am so disappointed with them. Though we're not rich, I still have the chance to shop on the supermarket but after I learned about those incidents, I am not going to set my foot in there ever. My sister in law can't help to cry when she told me about this IT staff's condition inside the jail when they visited her. She said that she is very frightened because she was being threatened inside, she said she is required to pay for this and that. She can't even go the comfort room because of fear that someone may lock her inside and do something bad to her. She can't even have a good sleep at night because of fear that someone would just strangled her. She keeps on asking if she really deserves to experience all that for taking a chocolate worth fifty one pesos. That is really heartbreaking.

Actually I had never heard about a strict rule in a company like this,I think it is too strict,even without humanity,as for the ballpen case,I think that sales clerk no need to prove that pen was belong to him but the hypermarket should prove that pen is the its belonging,if it can not prove this,then hypermarket should apologize to that sales man,and this is the really law.

It is really hard to believe. Maybe we are only aware about what could happen if someone was caught shoplifting. We know that they have to pay ten times of the amount of the item. But if you are their employee, you will be charged of qualified theft regardless of the amount. It is a criminal case therefore could affect their future as well. I also hope that their employees can still have the chance to talk to a lawyer before she or he was put to prison. But this company would make you finish your job while they are processing the report and would take you to the police afterwards. They don't have mercy. My sister in law said that even the barangay officials and the police repeatedly asked the representative of the company if they really are going to push with the case because they also think that it is inhumane but the company continued to file the case. I will never let any of my family to work in there in the future. I also avoid buying from them and really thought that their price is a bit higher than usual. I won't buy from such company that treat their employees that way.

a big company, especially a multinational company, set a high standard for their business that reflected in the company's rules. management run the business seriously and try their best to keep the company's performance meet the standard. two examples above, concidentially, the person didn't mean to do criminal. but, I believe the company already set a rule before, so the two employees was punished because they broke the rule. level of punishment differ in every company, depends on the character of the employees and the industry. I believe that management has a research before set a strict rule. regarding imprisoned, it is again, I believe has been considered by management to give a deterrent effect.

Thank you for your response. That is too sad that they have set such rules. I really think that someone from the HR department should have talked to them at least so that they can inform their family before they are brought to the police station. I really think that the punishment is too harsh. Actually, that is what the police said according to my SIL. Even the judge repeatedly asked the complainant because she also thinks that they are too much. I now remember the time that I was applying for an administrative position on a company of the same line. There are many questions in the exam which tries to determine your leadership traits. I did not passed the exam because in almost every question, I can't find the answer in the choices given. It was actually a multiple choice but in my opinion, the answer is not in there. I have also worked in the HR Department and I am very thankful that our HR Officer is very considerate. She can read people but still ask them for their reasons. But I don't think that this company would hire people like her. They don't have a heart. They see their employees are people who are just being paid. That when this kind of situation arise, they would just turn their backs on them. I really think that they are so unfair.
