hypothetical question,conman or not?

I was pondering something after responding to a thread on begging here at mylot about a beggar who is actually doing well earning on the streets.he is not a homeless person,neither is he unable to walk.
the things is that he usually does the begging seated on a wheelchair .But he never says a word or tell people he is disabled. He just sits and try to look pathetic.has a lady partner who pushes him around on his chair,has a note suggesting he may be dying soon.but now that i recall,there are no specifics on the words,something to the effect" life is hard, then i die" etc etc".
everything else is left to the assumptions and imaginations of passersby who like me got that impression.As i mentioned,just the visual sight of him is very sad,and many cant help themselves but drop few bucks onto a guitar case.he never actually ask for
money verbally,passers by just assume by looking at him and gives him money.
In principle ,is he a Con-man?
It just so happens that i actually know somebody who knows him,which is how i found out about his background. Prior to that,i wasnt any wiser and had the impressions just by the image.

Sometimes it's really hard to tell which is which. And the real con-men know this. And that's why they play on the emotions (and the imagination as well) of people. Like dressing up in tattered clothing, acting disabled or injured, some even deliberately put dirt on their face to make match their unkempt and disheveled appearance. Is the wheelchair-bound person a con-man? I also would not know for certain.
