cybercrime needed or not?

here in the Philippines they passed the law regarding the cybercrime regulated the use of social media as a means of communications or against bullying in the internet.. do you agree with me that it curtails for our freedom of speech and communications i do believed that as long we are responsible enough using this social media and internet we cant go wrong if ever there is is a law regulating it..however is this law timely enough and is this preventing our freedom of information by using new technology just asking help me enlightened on this issue....what do you think?

Hi, I have read the full text of RA 10175 and the only thing I object to are the redundant provisions in "SEC. 6. All crimes defined and penalized by the Revised Penal Code, as amended, and special laws, if committed by, through and with the use of information and communications technologies shall be covered by the relevant provisions of this Act: Provided, That the penalty to be imposed shall be one (1) degree higher than that provided for by the Revised Penal Code, as amended, and special laws, as the case may be." Why on Earth would be the penalty higher than the regular one as cited in the Penal Code? It is pure overkill to do so. If libel or other violations has been addressed by the Penal Code, then why reiterate it here? Explanations just escape me. If other laws hardly control these crimes, do they believe this one can solve it? Not in the least. It is pure waste of time to draft this, or maybe they have nothing else to do up there other than gorging on their pork barrels and coming up with lame excuses on their incompetence to solve the myriad social problems that we face.

Well this is just one provision in that law that may be defective or even violate the constitution as others opposing to this law are claiming. But I think the entirety of the law is really targetted against cyber criminals per se and not the ordinary responsible users of the net. I think this should only be amended and not abolished as we can see there are indeed many crimes that happen on the net that is left unattended simply because there are no laws that can really identify them as criminal act.

yes rsa101 ur are correct there are crimes committed in the internet yet not being penalized because of the absence of a law...however rog322 is also correct to harsh the penalty why not same under RPC anyways same as libel hmpp they passed it so fast

My friend Cyber crime is increasing day by day world wide and to control or to put the stop on it, Cyber laws must come into force. Countries all over the world have come up with cyber law so that it being stopped

so do u want that cybercrime law must also be passed not only in the Philippines but all over the world as long as there is an internet?do u think it would be acceptable?

Well being in the internet age right now, I think that it is the right time to have a law that will protect its users from harm against cyber criminals lurking around. We all know that the net is not at all a safe place with all the hackers, bully and phishers around. I think that the law is indeed needed. It just needed to be refined so that the law will be focused on the cyber criminals and not the ordinary users of the net.

Some people are responsible and some aren`t. I think that laws are usually made for people who need laws as limits because they cannot set limits for themselves. If everyone had used internet in a good way, noone would have thought of regulating anything. When I started to work online, I discovered that many sites were scams. I wished (and wish) that there was a way to place those thieves behind bars.

Hi friend, i don't think this kind of strict activities will spoil our freedom. Lot of persons misusing the freedom and doing some unwanted cyber harassment, so only government take this kind of strict acts. Hope this new act will reduce the cyber bullying and unwanted teasing activities. It will be good if the cyber crime is completely removed using some new law

yes you are so correct our freedom for information and speech is not an absolute right that we can enjoy...this law were passed here so that to regulate and avoid the harassment and bullying however there are some sectors who wants not this law be passed because of its curtails the freedom..but for me a little bit of revision specially on the libel side...thank you

Its not holding someone's freedom in sharing and communicating, but due to this user will use the social media network in a proper manner.

The Philippines is one of the few democratic countries where Libel is a crime with a mandatory jail term. Libel stops freedom of speech on its tracks and should be abolished. The law concerning libel is so broad that if I call somebody "ugly", I can be charged with libel. I just hope our government gives the priority of abolishing libel.

I don't think that the cyber crime would curtail our freedom of speech and communications. For me, when so much bullying in expressing hatred and threats is done on the net, cyber crime is needed. When so much stealing of personal information and the like is done to you, the bill is timely. Though, it just need to be polished as to the penalty and other aspects of it. I believe if we are responsible internet user, we don't have to fear the cyber crime bill.

I really think that Cybercrime law is needed today in our government. Because huge amount of criminals nowadays cannot only be seen on the streets but also in the cyberspace. And because of this law, we can already sue them for violating cyber rights. Unlike before, we cannot do about people like them because there's no law governing over them. :)

I am not sure what you are referring to. IF the law was put in place because of cyber crime such as, theft, fraud, child videos etc, etc then it's all good. I am highly against bullying on social media being considered a cybercrime. People need to live responsibly, If some steals your credit card online, you cant do much about that. Bullying online is exactly the opposite, as you could easily go offline.
