Insanity and Marriage Contract

The Hindu Marriage Act 1955 before its amendment in 1976 had disqualified a person from marrying if he / she was an idiot or a lunatic at the time of marriage.
A marriage contract is considered invalid. If at the time of marriage either party is:
1) Incapable of giving a valid consent to a marriage in consequence of unsoundness of mind or
2) Though capable of giving a valid consent, had been suffering from mental disorder of such a kind or to such an extent as to be unfit for marriage and procreation of children or
3) Has been subject to recurrent attacks of insanity.
The violation of any of the three conditions make the marriage voidable.
The major mental illness are :
1) Dementia - memory loss
2) Eating disorder
3) Sleep disorder
4) Mood disorder - anger / irritable
5) Anxiety - destroying things
6) Schizophrenia - disorganized speech
An abused child can end up in mental illness.
Signs of child abuse are :
1) Physical sign of child abuse - Fear of adults
2) Emotional signs of child abuse - Eating disorder, lack of concentration, depression
3) Sexual signs of child abuse - Bed wetting, lack of interest in sex, drastic change in appetite,
excessive aggression, fear of a particular person
4) Signs of neglect - Unsuitable clothing, un bathed, extremely hungry
Reasons why parents abuse their children are:
1) Unrealistic Expectations – Parents have unrealistic expectations on their children and they get surprised at the poor progress of their children.
2) Emotional Disorders - Parents who struggle with anxiety disorder, depression, bipolar disorder or other mental illnesses are less able to cope with the stresses of parenting and may be more likely to engage in child abuse. They are more prone to physical and sexual violence.
