Unfair or constructive dismissal

after several discussions with the employer about the unfavourable employment conditions, the employee submits the resignation form with the intention to resign. The section manager approves the resignation form but the employee does not hand it to Human resource Management for processing. A month after the section manager has signed the form, he instruct the employee to vacate the premises of the employer. Can this be regarded as unfair dismissal or constructive dismissal?
