Four categories of insane persons.

Under Indian Penal Code, there are 4 categories of insane persons who are exempted from punishment.
they are idiots, mentally retarded persons, people suffering of lunacy at different lucid intervals and one who is drunk. There is another category who is made insane by illness.
But for claiming exemption from punishment by the insane persons, the person has to legally insane and it is not enough to be medically insane.

has to be implemented to get good outcome.
Legally and mentally both has their own concepts and coverings.

Thanks earnnings. Under Indian law, for an accused to be legally insane, he cannot understand the nature and consequence of his act, and what he or she has done is contrary to law.

That is very interesting. It is hard to prove insanity. Some people fake their insanity.
Here in the US, people who commit felonies when drunk are usually punished. There are people languishing in prisons for drunk driving accidents that they don't even remember.

Thanks Jo for the response. In India also voluntary intoxication is no defence. Those who are drunk their liabilities get reduced as they are not doing the act in full senses, but they are punished also.
