Things have gotten worse

Two Fridays ago, my daughter was laid off, after only being back to work for two weeks. They offered her a month's severance, so we thought we'd be good to go once unemployment kicked in. Midway through the next week, the old job sent an email telling her she needed to sign a non-compete agreement that had a copy/pasted paragraph added saying she had to agree to not sue them for having laid her off because of her injury.
Sound suspicious? You better believe it!! She was one of three people laid off, but her boss was only told about the other two. She was a surprise. He was angry, updated his resume and began looking for another job. Plus, it took half a day to get them to give her access to the database after she returned to work. It's all TOO coincidental.
Now, today she learned that she isn't getting unemployment because she worked a second job the first week she didn't work at the old job. And, they won't give her severance until she signs the non-compete. We have NO money at all because once all the current bills were paid, nothing was left. No money for rent or utilities. Or gas in her car. Or car insurance. We had no idea that a second job would basically erase the unemployment covering the loss of the first job. Basically, we may be homeless in a month.

Doesn't she still have the second job? And, that's common sense. If you're currently employed, or quit, you're not going to get unemployment.

@kaylachan She's considering going to school, something she's never had the opportunity to do since graduating high school. She's worked full time since her senior year and neither her father nor I could afford to send her. The state will cover tuition to upgrade job skills, so she's looking into that. She'd have to buy her own books.

The lawyer told her to sign the agreement in order to get her severance. He also said if they tried to go after her for working in the same industry, he'd defend her for free. He's also going to work on the state to get her disability for the weeks she didn't work at all, even from home.

Can you talk to a lawyer without them charging you for an initial visit? I know around here you can. I could be wrong, but isn't it illegal to fire her for hurting her ankle? They are afraid to get sued for a reason. It's shady, and I am so sorry I can't be of any help. Please keep us updated if you can.

It is VERY illegal, but because we have no savings to fall back on, she has to do whatever to keep money coming in. She contacted a contingency lawyer who is working to get her disability for the weeks she didn't work at all, from both the state and her employer since the employer never gave any after approving it. It was it $23/week, but that's gas money.
