who should get the kids in a break-up?

If both parents are capable of taking care of the children, and if the parents cannot agree, Who should get the kids? I know at the end of the day its up to a judge but who do you think, Mother, Father or should the children, if old enough to be asked, and have a choice? Should the children be split if one want to stay with mum and the other with dad?
