Do you have a will or have you thought about making one?

Particularly to protect our children. I was thinking of this in the wake of the death of James Brown. Seems he didn't update his will and his 5 y/o son and wife? were not in the current will. Not so much to pass on our fortunes, but to have a say in what happens to our kids (if say both parents are killed in a car accident)is something that I think is highly important. If you were to die today, do you think your loved ones would know who you wanted to take care of your kids? Or your dog? Or what to do with your stuff?

I don't have a will. I have a will kit that I've had for about 10 years and one day will get around to filling it out. I guess if I die I want my wife to have everything and if we both die then our kids get it. My guess is that is what would happen anyway so I figure I don't have a lot of motivation to get a will.

We do. We had one when my husband went to Iraq. If not, there would have been a big stink over who got the kids had by some odd chance something happened to both of us. The kids are supposed to go to my parents but my husband's parents would try to take them...my parents have no kids and my husband's dad still has 3 at home.

I personally think that make a will when you will to gain or divide your family. For instance, a person could make a will, but it may result in to greedness by his family members or ignorance to others and show care for you when needless. In some families the reverse could happen. I think the person having no money or a specific limited money doesnot have the tension to get in will and all things are most satisfied people in this case.

Sure do. I left everything to an animal agency and keep it in a bank deposit box with supporting documents why I made this choice and should be used if any family member tries to probate it.

I made a will before i went to Iceland back in '05.. Was pretty hard at the age of 24 to think about the possibility of not returning to my children. But nothing happened and i'm glad i got it oevr and done with..

That is something to think about.I am a single mother of three and I want my kids to be safe.That is very important.I think when i decide to do my will i probably will be crying just the thought it.I need to have one and I am really considering thankyou for bringing this up.Take care

Know we do not have a will we have thought about it tons of time and talked about doing it but never have yet. As far as our boys yes we do know where they would go to my parents. I think that is the only think we haven't planned for are future.

Lately, I've been thinking about a will and whether I want to be buried or cremated. I think cremation is cheaper. I don't want this to be a financial burden on my family. I may look into burial insurance. Sometimes I feel I'm going to go at any moment. I probably need to get my soul right, too.

You are right...PArents or people who have fortune here on earth must decide whom to give their fortune so that there will be no problem after they die...its like securing the future of your family which is important.

A will is not only for people who have a fortune. There can be a lot of hassle and bickering even over small things. A will is important. In Australia the Public Trustee will help you make a will at no charge.

Me and my husband have to sit down and fill our will out. Everyone should have one....tomorrow isnt promised, and its nothing like being prepaired.

Its so coincidental that you post this! Reson being- I had a little injury about 3 days ago and when I went to the hospital, they asked if I had a living will! I was shocked actually but it made me think that maybe i should have one especially considering that my closest family member is about 4 hours away and the rest at least 8 and up. What do you even do to get a living will? I mean of course we cant just write up one and sign/date it with a witness! Or can we?

As far as a living will goes, it depends on your state. Most states, yes, you can just write it up. but why re-invent the wheel? Most hospitals have pre-printed living wills that they will give to people free of charge. Then all you have to do is fill in the blanks and it already contains indisputable legal language.

I need one now that I have a child. It's so hard to come face to face with one's mortality though and I believe that's why so many people put it off.

U have a current will, and although I don't want my ex to raise our daughter, I understand that I won't have any say in that should something happen to me. But I have executors and they have been given strict instructions to safe guard my daughters inheritance should I pass away. For eg, my daughter's dad will have to give bills to my sister (executor) for school related expenses and she will pay them out of her inheritance. He won't get access to any of the money directly because he doesn't know how to save and build a nestegg. He would spend every cent he had and even go into overdraft the whole time we were together, why should I trust him with my daughter's future??

this is an excellent set up and a good example of why wills and living trusts are important. Bully for you !! I think looking out for our loved ones that we leave behind is the best use of these type of documents.

They will have rights even without a will, but having an up to date will makes things much easier and less expensive

I do not have a will as of yet but am getting ready to start having one made up. I already bought the materials to have one made and have to take time and sit down and think about what I am going to put on there and who my belongings and everything else will go to. My parents know they would be the beneficiaries.

I don't have a will. I am planning on making sure I have a Living Trust. My aunt just passed away last month and I have been dealing with all of her issues. I think it is extremely important to have such a document and update it regularly. In my aunt's case she didn't put her bank account in the trust so the trustee is having difficulty doing anything because he doesn't have access to those funds. It is also important to have it done by a professional. Although you might have to put out money it is much better to spend the money know it's been done correctly.
