Not guilty by reason of insanity is a defense used in criminal cases.

In my opinion this is a bogus defense.?I believe that a person should be found guilty but insane. If this was the verdict the person would first go to a hospital for treatment and if they were at some point determined to be sane they would at that time go to prison to serve their sentence. Do you feel that this would work or do you have another way to punish those with diminished mental capacity.

I have thought of this for a long time. I have no deep knowledge of the law but it appears unfair. One concrete example is what happened here. A family was murdered but the criminal was acquitted based mainly on this very reason, insanity. A crime is a crime whether committed by a sane or an insane person and both should get the same penalty for committing such a crime. There is no reason why an insane person should not be sent to jail. Jail for the insane, maybe, I don't know.
