Anyone in Canada, do you know if a company can do this?Okay... I will admit this was a dumb idea, but a year or so ago I took out a payday loan with Cash Factory. It wasn't a big loan. I paid on it once, and fell behind on the second payment.
Of course I still owe them money, I don't doubt it. I also know from the time I took the money out, they tacked on 70 percent interest.... quite a bit and over the legal limit in Canada.
Anyways... I fell behind on the loan and I couldn't pay it back. I ended up going on leave from work and it fell behind. Okay I am not saying I don't owe the debt because I know I do.
So... a few months passes, and I lose my cellphone number. Okay fine. Then I find out they went looking for my MSN user name, and one of their employees added me to MSN Messanger. They were talking like they knew me personally, so I thought it was one of my friends from some of the online sites I visit. Then she admitted to me that she was the manager of Cash Factory, and that I needed to come in and make a payment - even though I had told them I wasn't employed. I blocked and deleted her from MSN and filtered my MSN space so they couldn't go in there again and read personal information on me, which she did.
Then they followed me to my fotopage, and on an entry which was a year old at that point, one of their employees made a comment like "Hmm nice pictures, good to see you can afford a trip down to Vancouver but not to pay us back, you need to come in and make a payment on your loan" .. And yet, the trip had been taken quite a few months before I even took out the loan with them. Not cool.
So when I went into the hospital to have my daughter, someone again from Cash Factory tried to add me on MSn, and of course me recognizing the user id, I blocked and deleted it. Okay fine.
My hubby and I were walking by their store one day, and we were three blocks down the street when the manager of the store followed us down the street, and in public said "so when are you going to pay your loan" and then proceeded to threaten to take me to court if I didn't pay. Um, this woman knew I was on mat leave, she knew I didn't have any money, but yet she found it alright to chase me down the street in the public and say this.
And she did this not once, but a couple of times. I would be downtown going shopping and she would literally come out of nowhere. And then she found out my home phone number, and was calling me at home - telling me if I didn't pay her RIGHT NOW, she would have my child tax benefit taken away, and how she would tack on 400 dollars to what I owe right now (which by rights should only be 200 dollars!) because a judge would agree to her court order.
Now, I know in Canada they will not garnish a child tax benefit check. I have emailed this woman a couple of times (we did communicate through email but I don't think that is enough for her anymore) and I have told her point blank I cannot pay at this point in time as I have no income, I am not slated to go back to work until May. But she will not listen.
Does anyone know if there is anything I can do legally to stop this woman from this harassment? She has been told by me that I cannot pay. According to the Debt Collection Act, she is only allowed to call me once a month, at home, asking if my situation has changed. Not only does she not do this, she threatens me on every phone call. Its like she doesn't listen when I tell her I have no income at this point in time.
I have emailed Business Practices of BC on this matter, and I really hope they can give me some light at the end of this tunnel. I have no problem paying her back once I start going back to work, but right now I can't pay anything.
What would you do??What can I do??

Well I don't know what you can do legally. I'm not even familiar with the laws concerning it in the us. But I do know that some of these people trying to collect blood from a stone are ruthless. Somehow a bill collector got my brothers phone number and kept insisting that my mother was there. My brother had to put a message on the phone saying if you are calling for ... .... you have the wrong number, do not leave a message, please hang up anyone else please leave a message. I mean it hang up if you are calling for her.
They are crazy sometimes.

next time they call you, tell them to never call you again, and if they do, you can get the phone company to trace their calls and they will haveto deal with the police then.I suggest you get a restraining order against that crazy woman, since what she is doing is illegal, then if she acosts you again, simply call 911 and have her charged with stalking. You should attempt to make token payments, since you should be receiving at least EI or child tax credit

I did try going the token payment route, as I am doing this with another company, however they wanted more, and more frequent payments - more than I could give them.
I mean I did offer 10 dollars a month even that so I could slowly pay it down, but it wasn't enough. They wanted 25 dollars every 2 weeks which I couldn't do.
