Has anyone ever been evicted? What steps are taken in this? I got a 3 day notice today....

America probably has a quite different eviction process to Australia, we only have to be given 24 hours notice then they can turf us out. I think you get like a week to remove all your stuff or something. Maybe try looking up the policies for your state,country on the net...?

Thank you for your insight-I am just in panic mode right now....I am sure things will work themselves out....I just hate being like this in this kind of situation.

It must be so hard, just stay strong and try to keep a smile. I know it sounds silly but if you can get through it all, youll be a stronger person for it, and if u can keep a smile youll have a better attitude...

I've been a property manager and can tell you the steps leading up to eviction and the time frame it takes in TExas at least. After you haven't paid rent you are given a notice to pay or move out. After whatever the time frame given in that notice goes by, the landlord can then go to the courts and file for eviction. At this point if anyone runs a background check on you, they may be able to see that eviction has been filed against you. From that point it takes an average of 13 days to get to court. The hearing is held and if you lose then you are given usually about a week to get out of the apartment. If you are still not out at the end of that week, a constable will arrive to oversee the removal of your items from the home by the landlord. Moving out at any point will stop the procedure. Make sure that you do go to court even if you have moved out because some pissed off, unscrupulous landlords have been known to tell the judge you still live there even after you've moved out, just to get a conviction on your record. Paying the amount of rent and utilities (not late fees) owed will stop the process any time up until the court date. Note: the landlord is allowed to refuse payment if not in the full amount but at least you can show the judge you tried to pay what you could, if they do decide to refuse it. Helpful tips: Go to your local housing authority and ask for the phone numbers for emergency rental assistance. If you have a tenant's council in the area, ask them for advice as well.

Did you sign an agreement, or a contract before you moved in. You do have tennants rights don't you. Check out the fine print on your agreement and also talk to the landlord. If you tell them why your in the situation you're in then i think that helps with the stress. Good Luck!!

Yes, I don't have the money and no one has any I can borrow...I am SOL...I can't determine weather to be scared, pissed, or just cry.....

Do some research online and find out if your city or town has some sort of tenant's group. It might be called something like "[Name of your city] Tenant's Union." Call them up, and ask them what to do. They should be able to point you to somewhere where you can get free emergency legal help. If you don't have a Tenant's Union or similar group, call your local Legal Aid. Don't wait! It's important to act quickly.

Well my main worries were gettingmy credit screwed over bfroe I could get into another place-get this-I appled for an apartment yesterday and passed the credit cecka dn now I just hae to wait until the place is ready! My credit hasnt been affected yet! I am so thankful-praise the Lord!!!

I've never been evicted but I worked for a landlord one time. If you got an actual eviction notice from the court then in 3 days the police will show up on your door and escort you from the premises (forcefully and in hand-cuffs if need-be). If you got a landlord's notice then usually you have a little longer b/c they have to go to court and get the above order. But I can't promise that's how it works everywhere.

yes about 11 years ago. that's when I met my Husband he was trying to help me pay my rent but they would'nt except it. so I was evicted. my huband and I have been together every since.

Yea I have, I couldn't get the rent in for like a month so he evicted me. I had to live with my mom for some time, but then she kicked me out.

Ive never been evicted. By law, nobody can give you a 3 day notice. You have 30 days to get out if they are evicting you. Why are they evicting you?

you are right! first they give you a 3 day notice, then in 30 days you half to move, but you half to go to court. and it is a slow process, but 30 days. be in a place.that should give you time to find another place.

I was evicted once, years ago. But I am a paralegal. The three day notice doesn't actually mean you have to move. They still have to take you to court. If you don't leave within three days, they'll have to file and set a court date and the judge will evict you if you are not current by the time it goes to court... he'll give you the firm date you have to move out.

I've never actually been evicted, however, I received a notice to vacate if rent was not fully paid within 24 hours not that long ago. I can tell you, it was scary as hell, because I've got a young baby and little money... Anyway I ended up resolving it with the real estate, borrowed the money off my sister and paid it in time! I know that probably doesnt help you all that much but thats my experience...
