I am myself an ex smoke and have no problem with people smoking in pubs, clubs resturants and so on. I think it should be down to the individual business to decide whether to permit smoking in their building. The Europena Convention for human rights article one states. Every natural and legal person is entitled to the peaceful enjoyment of his possesions, and no one shall be deprived of this. Giving that the whole of Europe have signed and agreed to a convention that includes the above statment as the first Article are the British Government breakig EU Law by depriving smokers of their legal right to peaceful enjoyment of their possesions (their cigs)
