Eviction Hearing Question

My Landlord is also my moms husband and I rent one of his apartment buildings he owns, but he has a hearing tomorrow about the lady that lives above me. AFter not paying her rent for like 2 months and he got tired of all of her excuses he sent her an eviction notice and she didnt leave by the time she was told to. So he is taking it to the court that does this. Well she is going around telling everybody that if she doesnt show up, they cant evict her and that is what she might do. I was just wondering what would happen to her if she doesnt go to the eviction hearing tomorrow? I asked my mom and she said that would be stupid and she doesnt know because that hasnt happened yet. So I was just wondering if you know, could you please let me know what would happen to her? Thanks so much for the help!

If this woman does not show up to court a default jugment will go to the landlord, the judge will then have a constable post the eviction on here door if not able to give it to her by hand. She will be given five days to quit the property. if she does not leave then, a writ of posseion may be filed and then the land lord may forcably remove all her belongings to the stree corner with a constable present as witness to the forcable possesion. She is stupid if she does nopt show up. If she goes she will be able to tell the judge any reason why she hasn't been able to pay her rent, ask for lenioncy and a pay back scedule of past due rent. or ask for more than five days to vacate. I have filed too many evictions not to know what I am saying here.

She showed up today a half hour late.. The judge was not to happy and then she tried to give him a lot of excuses and he didnt like that. Also she was like it is christmas time. But The landlord pays all of the utilities, and that has to be paid by a certain amount of time and her rent is only 500. So she should really have no problem paying it. But the Judge gave her 10 days and then if she isnt out the landlord gets to call the constable and he will only give her the chance to take whatever she can carry out and the rest goes to the landlord and if she isnt there then she gets none of her stuff. Well when I was having money trouble and my lanlord was going to court they told me,no matter if I am there or not,if I say I owe this money I do,or if they can prove I do then they will put a judgement in for me to pay,if I don't I will have no other choice than to move. I think this lady is just trying to start some stiuff,I could be wrong I don't know if the rules are different in other states,but I wouldn't let it bother me until after the judge talks.

If she recieves a paper to go to court then she has to go to court. If she doesn't go, she's gonna get arrested. Her rent is an agreement, she leased it? If she did, she has to pay the rent, she breaks the contract by not paying the rent which means her butt is out of there. She would be stupid, I wonder who she heard that crap from that she can't get evicted, your moms husband can just get her butt arrested to get her butt out of his property wtf.

She went a half hour late today and yes she has lease with the landlord. He makes sure we all have one, even me and he married my mother. LOL. Yeah, I also dont know where she heard that from. But the Judge was a little annoyed by her.
