cancelling a contract

May 25, 2006 12:43pm CST
I wanted to know if it is true that you have 48 hours to cancel any contract and get a full refund. I signed my daughter up for a school and the next day I cancelled the contract. The "school" is claiming that they will refund $475.00 of a $975.00 deposit, but they are keeping a $500.00 registration fee. It did state in the contract there was a non-refundable $500.00 fee, however, the woman we were working with led us to believe that if we cancelled the next day we would get a full refund. Just wondering what recourse I have?

Most states - maybe even all states - have a 3 day policy - you can return anything or cancel any contract within 3 days of signing that contract. If you were led to believe that you could still get your registration fee back then you should contact the Better Business Bureau and ask them to help you get this month refunded. That school does not sound very ethical. If I were you, I'd mention them by name on here and warn other people of what they are getting into in the do business with them. A $500 registration fee is excessive, especially if you cancelled the contract the very next day.

Talk with a local lawyer. They usually offer a free consultation visit. They can even help you handle it from there!

If the contract stated that the deposit was non-refundable, unless there wa a time clause in the contract, you are out of luck.

Sounds like you might be out of Luck. You might have needed to make sure and Read over the fine print before signing anything, or paying anything, as this is always the safest bet, as then you are prepared for in the future. Sounds like you should have kept your daughter in school if it means a loss of $500. That is a lot of $$.

Yes, i think it is true there is a cool of period by law. I am not exactly sure and dont want to mislead you, but i think it is something like 24-48 hours cool off period to change your mind. I think you should call a solicitor and see what you can do about it. In most cases you can have this money back.

Wow, that is conceiving though. If the contract stating that you can't get the $500.00 refund, you won't get the $500 refund. She can't simply talk you into believing that could work if you cancel the contract next day. You should talk to the school administrative office for this issue.

"Before signing on the claim bond paper we have to read the particulars clearly", it is must. If not we have to round the courts.

Hi mialexzj, Each contractual contract can vary and it depends on terms you signed at the time of the agreement. Most business contracts say you have 3 business days to cancel but then again you will have some contracts that say no refunds stipulation. It is unfortunate that verbal understandings lead to misunderstandings when it comes to contracts, as the courts will favor only what is in writing. If there were no written and signed contracts then the courts would weigh the verbal agreements to get to the truth via the law. Unfortunately no verbal agreements hence after signing a document make the verbal agreement non-binding. I do hope that all was resolved and that your daughter attended a great school.

If the lady you were working with told you one thing but, the contract said another, she definitely misled you. Maybe you can call the better business bureau to see if they have any suggestions on what to do. It's like an Insurance Company selling Life Insurance that's not to your best interest but, you keeping paying your premiums anyway because you didn't understand the contract.

If it was stated in contract that the amount which was deposited it would forfeited in the case of cancellation then there was not any way to do if it was not stated any where in the contract then the school must have return the amount of deposited.

I hope that you were able to get your full refund! It seems crazy that they would keep that much of your money. Wow. I had no idea that they could pull such a stunt. I mean, you pulled out within 24 hours! That's crazy.

According to me u will only be getting $475 because in the contract it was mentioned that $500 will deducted as a registeration fee if u cancel the contract

Wel, how can u belive words spoken by that women. Contract has been described on the paper u should have first read that. I think it is your mistake. But I am unhappy by the amount of money they r not refunding. 500$ is too much..

If it's written in the contract that there was a non-refundable $500.00 fee than there are no change for you to recover your money
