Who's at fault here?

There is a woman suing Starbucks for $250,000 saying scalding coffee and an unattached lid caused her to get 1st and 2nd degree burns. Ok I can understand Starbucks coffee and sometimes be served too hot and the lids don't always like to stay on. But this woman lost me with they way she got burnt. "She experienced extreme heat radiating through the cup and protective cardboard sleeve," Isaacs wrote. "(She) balanced the extremely hot cup of coffee on her thigh with her hand on top of the cup as she pulled away from the window and negotiated a turn onto the roadway." Once on Kingston Pike, Triplett noticed "the lid of the coffee container was loose and not affixed properly," the lawsuit states. "Before Triplett could achieve a better grasp upon the cup, the lid dislodged from the cup, thereby causing scalding coffee to spill and splash onto (her) lap, right thigh and right hand," the lawsuit states. If she knew the coffee what hot why in the world didn't she just pull into a parking spot, place the cup in a cup holder (hello that's what they are there for) and fix the lid? Why do this balancing act while driving? Can we say wreckless driving? If she had caused an accident and hurt someone would she be at fault or Starbucks? http://www.knoxnews.com/news/2008/oct/25/starbucks-faces-burn-suit/ While I feel bad for her and her burns I think this just comes down to people just needing to use their common sense. What do you all think? Does she have a case?

She is, but some people will do anything to get money. Why should we get paid for not making good choices?

I hope she loses! She is just trying to earn a buck the same way McDonalds was sued in 1992/1994 over the same complaint and that case cost McDonalds about $600,000.00. Any idiot who balances a hot drink on their thigh deserves to get burned.

Ok clearly it is not starbucks's fault for her stupidity .. i mean if i read corectly she drove while balancing a hot coffee on her knee???? that is just rediculace.. wow some people just have to smarten up..
