You are a boss of a company and have these two employees who violated the same policy. In addition, their performance is on equal footing. Their only difference is their looks. Who are you going to terminate? Is it the good looking one or the "not so" good looking employee?

No one like to be terminated, but there are some characteristics that will truly push a company/ boss to do so, if he/ she doesn't know the following; a. company history/reputation b. company mission (vision) c. work/duties d. working environment e. people

If I am the boss of the company, then I would choose to let each one off with a warning. I could not keep either one without retaliation from the other crying discrimination. Better to be safe and give them equal punishment. Also, what kind of message would you be sending your clientelle if you punished one employee and not the other? I could end up losing business, so I wouldn't terminate either one of them for the sake of the company's reputation. I would definitely give them "time off" with no pay, or something else of a legal nature to get my point across.
