The driver should not be held responsible. The reason I say this is because this innocent animal was put into danger by the owner that did not insure that the animal could not get out of its yard. If I ran over a pet I would feel sorry about it but chances are it would also damage my car and I would want the owner to pay for that damage, they afterall, are the reason the pet was in the road in the first place. I know that this does not agree with the previous posts but I cannot justify sending the driver to jail for the negligence of the pet owner.

If a parent doesn't watch their child close enough and they run out in the middle of a road and get hit, then since its the parents fault for not preventing that??? And if the driver just says "oh well, what can I do?" and keeps going and doesn't help the child, then he is fine because it was the parents fault that the kid was in the road???

ok put aside damages, but would you be the type of person that would let an animal die if you hit it????????????????????????? I keep my cats very safe indoors but i have one cat that if i open a door, will run out and sometimes I cannot find him.....would you think it would be okay to run my cat over and not stop to try and help it? Would you think it would be justified in not helping someones pet that they have had since they were a little girl? I'm not talking about jail or money, I'm talking about being humane and not being heartless and cold....so honestly, what would you do??????

First there is a huge difference between a person and an animal. Hit and run is illegal in the United States. I would be beside myself in anger at the parents for not watching the child and here if a small child is hit by a car there is usually an investigation on the parents. I mean good greif how hard is it to keep your child out of the road? But since we are talking about animals, pets, the owner is responsible. Same basic concept: How hard is it to insure that your beloved pet cannot get out of the yard. Besides all that I am not going to pay for an outragious vet bill, because some person thinks it is ok to let their animal run loose. That is not only dangerous to the family pet but also dangerous to the whole neighborhood.

there are some nasty idiots driving about. all this driver had to do was either pick up the dog and take it to a vet or just phone the emergency services and let them deal with it. as he (presumably) couln't be arsed doing either then i will agree thay he needs a spell in prison for thoughtlessness

Calling 911 in the state of Texas for a hurt animal could get you a ticket and a fine if the county you live in does not agree that this is a reason to call them. Abuse of 911 is considered a crime. If you are concerned then keep the shelter number in your cell phone (if your county has one) in some places if the police show up and the animal is in bad shape they will simply shoot it. In these same counties they are known to pick up a loose animal and as they have no where to keep them, and if the animal does not have a chip or a tag then they will still put the animal down simply because it is running loose.

Yes the driver should be caught by the police and charged with killing an animal, or animal cruelty.....that is horrible if someone does something like that because it shows that they are cruel and heartless and do not care that they are causing another living thing pain,,,,and I think that they should be put in jail for a very long time, people who do that are sick and deserved to be punished with jail time.

I know a blind people that have seeing eye dogs and other people with disibilities with pets to help them. They are responsible for their animals and those animals would never be out of the owners sight. These animals are well trained and would not leave their owners. If a seeing eye dog is run over then the woner would not receive a replacement dog unless and until they proved that the could and would keep that animal with them. So the odds of hitting one of these animals is so small that it is not even an issue here. If you hit a working dog then you will hit the owner at which point leaving the scene is considered a hit and run on the count of the person and the animal. These animals are protected by law due to the fact that both the pet and the owner receive many hours of training.
