You did not mention what kind of company? What products? Marketing or Manufacturing? Can you please substantiate?

If you are in the United State, when you apply for incorporation, almost every state does a search determining if the chosen name is already being used. Incorporation is a big step. Most individuals operate as sole proprietors. Names of sole proprietors can not be protected in most cases. Check with your state and local agencies. You can find these through the local Small Business Administration or local Chamber of Commerce. Good luck.
