Negligent to dogs

Yesterday a man in the UK was convicted of negligence towards two dogs that died last year. The man was a police officer and dog handler. He came to work with three dogs in his car and took one to the kennels, but left the other two in his car. It was a hot day and due to heat exhaustion and dehydration they died and he discovered them when he returned to his car. It may seem like a clear cut case - he caused their deaths so he deserved to be given prison time BUT he was ill at the time - mentally ill. He had developed a number of problems including obsessional compulsive disorder and depression as a result of his work. He became distracted and it slipped his mind that the dogs were still in the car, he thought he had put them in the kennel. He was distraught to discover they were dead when it became clear what had happened. Do you think he deserved to be given prison time when it clearly wasn't entirely his fault due to his mental problems?

Sorry but the mental incapacity alibi had been is abused. When people get to pay for their crimes they use that. If in case he was really mentally ill, shouldn't the force do quarterly testing to assess the emotional state of their clients? Sorry but I do not buy that.
