How do you feel about malpractice?

Malpractice is when a medic does something wrong by accident ... or not. I recently red an article about this doctor (urologist)that accidentally removed the wrong kidney from a patient, action that caused the death of the patient. He now faces charges of manslaughter and was found guilty of "gross negligence". What do you think about that?
