The great MJ Debate

I came across a news story regarding Medicinal MJ. A man who was diagnosed with carpel tunnel syndrome, currently smokes to alleviate pain. His x-wife filed a custody dispute for their two children. The gentleman is allowed supervised visits. Because government cannot regulate, how much is smoked to treat pain, he was denied custody. Now, i think that it is quite easy to get a medical MJ card for pain. Oh my eye hurts, here have a card. However, in some cases i think it really does help, say cancer patients, and plus no withdrawal symptoms as prescription pain meds. Now, whats the difference if someone was prescribed pain meds? Unless there is proof of abuse, should your children be taken away as a result?
