Friends. Does insurance cover expenses for medical malpractice or does legal court handle the claims?

Here in Illinois the Medical Malpractice insurance rates are very high. This I know as I use to work for so many doctors and applied for medical malpractice insurance for them. Yes Medical Malpractice insurance covers the doctors and most of the insurances like to simply settle the claims, sadly. I say sadly because lots of times there was no fault on the doctors yet the insurance companies prefer to settle and make it go away. Some head strong doctors will fight it in court and it can take years to settle it, in which case their costs increase yet more.

Medical malpractice really is hard to prove. In fact, here in the Philippines, insurances pay the claims just the same. If i may further add, there has been very little legal hearings when it comes to medical malpractice as the patients would just let it be and suffer the complications of wrong treatment. Which makes me wonder... are there such doctors who are lawyers as well?

Here most doctors that I have worked with were not lawyers, but have dealt with enough malpractice claims where they know what to fight with. Sadly there are a lot of negligent doctors here too, where they do end up paying for the damages, but what is money if damages can't be reversed sadly. I have also seen some patients not follow orders after surgery then sue fowl on the doctors and sometimes they win regardless as malpractice insurance companies at times just want to settle.

For medical malpractice, mostly the legal court handles the claim. As for the victim, maximum compensation can be achieved through legal court. Hire a medical malpractice lawyer, so that he could direct you on how to proceed in legal terms. You can get more information on medical malpractice
