marriage contract or "last will and testament"

There is this man and wife, with children who got seperated, they were on their way to annulment, and so the man is already living with a new woman in his life for 5 years already. then he died even before the court give them the annulment, and so his property and money will go to his family and legal wife...but he made the last will and testament that he wants the new woman to have part of his property and also his children, but didn't give any to the wife...which is more powerful, the marriage or the last will and testament??

the legalities of many things in this world add to the complications of the matter. although at times, legal matters simplify things. more often than not, they complicate things. it is unfortunate that the last will which is the real and true intent of the owner will not be implemented in this case. how sad.

indeed sad, but is it really the verdict? if so, then any last Will of whoever person should not be honored also. why only in this case?

wow,its more of an iggy arroyo case, is it? Well on my opinion and what I have heard on tv discussion, there is a law, it goes for the legal wife and children (since the marriage is not annulled yet). A deceased person is just as good as wood so even if in his last will goes for the recent woman that he was with, the law will not follow the last will. You married a woman, when you are done with her, you get a new one and so forth. This is how some men treat the lady, just like the cars when it is brand new. the pain of the one left behind for someone else will not be healed and the only good thing that he can do before he die, is to at least make sure everyone get what must be for them. His other woman will get married again and spend his money while he is decaying in his grave.

oh yes very true, i was just wondering because a parent can also disinherit a child, and the last will should be honored, just like the case of michael jackson. anyway he was divorced...but parent and child are true blood related and yet can be disinherited through a last will...

This is a difficult one. Really in both cases one overpowers the other but to whose benefit? Maybe a lawyer should be consulted on this one.
