You have to tell him first, and if it is OK with him only then you should date his brother.

Is it okay for you. Sure. .. Is it okay for the brother?? Probably not. If you don't care about the guys feelings then go for it, if the brother is down and so are you then who's to say you should not. It just depends on your own conscience, can you live with yourself if you partake in something like that??
