I hereby take this valuable opportunity to thank all myLotters who have been through thick and thin with me..regarding my two cases. Update on the bank case is...judge declared loss of first page as deficiency in service. Agreed with me that the bank will be in position to shred the "letter of comfort", and deny its existence, and that Encumbrance Certificate was useless considering that banks are not registering their claims, and therefore certified copies do pose a risk. He scolded the advocate ..if she asked for indemnity bond, why did you not give it. Yeah boy. He then asked me for the copy of indemnity I had asked for, and he said get it prepared and bring it on the 4th July, 2018, by then we will decide how much would be reasonable compensation. Their advocate pleaded let it be negotiable, he said that is between you two, we will decide compensation, you two can negotiate and bring it down if you all want. Phew........ I got labeled as a liar in a public record................sigh...natural that I was ANNOYED. Anyway....... thanks to your prayers, and encouragement and support, I have been through this mental turmoil...and survived...in the morning I had massive cramps...I was not able to walk...so stressed out was I, but now it is only a headache...nothing more. I am going to take a long break...make up for the lost sleep. Thanks to one and all ..you all have been gems...really patient with me...love you all a lot... hugs...hugs...hugs...

I am so glad Vanny, a good agreement will be better than a long dispute in front of the Court. Do not ask too little.

Under recent new rules, they are going to cut it from salaries of Bank employees. I don't want to pinch them so hard that they become too nervous to do anything. Mistakes do happen. But I will safeguard my interests...for long term and get them to admit in front of judges that they lied, and submit a letter which will be attached to the case paper stating that whatever was denied was actually true and that I had not concocted, or lied. Winning was more important than the monetary aspect. It will ensure that prospective buyer is confident of buying it.

@lnillerman I would never want anybody ...anybody to go through such tensions...we suddenly start looking older ...we don't get sleep...and money keeps going out to advocates. Only advocates benefit.

You cannot imagine how it feels...morning feels pleasant...I had actually slogged for loans towards the end. Now it feels like I am a free bird. God knows it is hard to keep yourself from being a cry baby all the time. Thank god for friends like you...and people who have good sense of humor...

Hearty Congratulations Dear @vandana7 ! So on 4th of next month you will be negotiating for the compensation. I think you have already drafted the required indemnity and you will prepare it for 4th july to be present it in the Court of Law! Wow! Great ....I am really happy about you! Just chill and relax! No No...I had already sent the indemnity. Indemnity and undertakings are to be prepared by the Bank not me. I merely gave them copies once more..one copy to the judge, and one copy once more to the advocate of the bank. Judge said I find nothing wrong with it.

Yes, it is helping...net was down I had not switched it on until a couple of minutes ago. It is really helping to relax. Thank you so much. Yeah..it was traumatic. More so because dad and uncles were saying you are stuck for life now. It has finally ended.

@vandana7 You stand your ground and don't let them bully you! You know what is right and you are remarkable standing up to them. I did the same with my wifes cousin. He was assistant chief commissioner of police and everyone feared him. What he said was law as far as her family were concerned. I stood up to him......OH my the picture of his face is still with me. They were petrified after I told the family what I said to him. I told them no he is no better than you or I he is just being a bully! He was a different person to me after that! The shear audacity that I had stood up against him something I don't think he has ever experienced before! Wait for the outcome and then you will be able to have your day and tell them exactly what you think and thank them for their lack of support!

Yeah..it feels terrible to be left with a property that cannot be protected demolished and rebuilt, willed, etc. after having paid home loan for over 11 years especially if the last few years you have worked harder staying up late in the nights getting up early in the mornings..

@vandana7 Hey people do that here as well drive without that. Its so good to find relief when things get really tough. I seek out the silence to give me back my strength as well but I like to come here to see how everyone is doing. Hope everything is much settled as prolonged stress over time is not good for anyone and don´t I know it and like everyone else I suffer too if I let it all go too far. I took some break ..and caught up with my works which have been pending for oh so long, and they couldn't wait. (Renewing driving license...confession ..I drove without license for almost 3 months LOL) then medical insurances ...next month I have tax returns..so some information collection work. A little bit of shopping for dad's birthday..suddenly everything seems so overwhelming. LOL. But definite relief. Two days I will be here...missed you all so much...hugs hugs hugs to you as well...I can very well imagine how it feels at your end, and understand that somethings cannot be shared here. Yeah...we naturally believe that we have genuine case but the fear lurks..."there is always a slip between the cup and the lip". Am I mistaken, kind, what am I missing...have I considered all facts, do I know latest developments, etc. etc. etc., and even if I am arguing will I remember all the points in proper sequence, will I miss out on anything crucial kind. Will there be objections raised, making me forget something crucial. Yesterday there was another case in which the person sued the transport company...for damaging his car. The transport company claimed it to be act of god. The case was genuine. But it was dismissed on frivolous grounds. 1. The consumer court had no jurisdiction at this end, as the case should have been booked at the starting point not in transit location. 2. The contract mentioned that trawlers will be used, and it was while reversing that the accident happened. Our justice system is flawed. Such grounds which seem to be unfair should be overlooked by the judges so that shrewd people do not get away with wrongs.

@Shiva49 The lawyers want disputes..how else will they survive. LOL. In this case, attempt by the Panel advocate was to display "I have the best interest of the bank in my heart" so he refused to give indemnity using all false reasons. He presumed because I was old and so is my father, we would not consider approaching the court. I did so he has declared me as liar on (15 x 2) + 14 in a public record. I am understandably miffed about it. When I won...he said I know those things happen...like hell they happen. If Bank's reputation is important, so is mine. I will take full compensation.

@vandana7 Some lawyers are known to be influential to get the cases going their way. They are able to bank on their reputation to garner much higher fees than another who is honest and sincere. Forty years ago I was CFO in a big company employing 500 people. There were disputes with regard to gratuity calculations with the result over 20 elderly people were not paid. We were having cases from Labor Officer to High Court. I told the union both the parties were wasting money and I would rather settle the issue across the table. They knew I could be trusted 100%. In fact, their lawyers did not want settlement out of court but the union believed in me and I managed to pay off all. I told them I want to see that they get paid before they leave this world. Our sincerity counts. In the calculations, one was paid less due to error. I paid him and he said whatever I had calculated was beyond reproach according to them. I was touched; these things matter till our last breath and even beyond - siva
