There was only one single juror that refused to find the Moulder Brothers guilty. This juror refused to participate in any discussion with the other jurors, and should not have even been allowed to be on that jury. Had the judge or DA been told that this juror was refusing to even discuss the charges, they would have been discharged, and an alternate used. This juror simply would not convict under ANY circumstances. The 11 other jurors AGREED the Moulders were guilty of every single charge! DA Paul Howard said he was ready to retry the Moulder brothers today! Spokesperson Lyn Vaugh said that the Moulder Brothers will be held without bond until their new trial begins on JANUARY 3, 2007 at 9:00 AM !!!!!! If you live in GA. PLEASE make arrangements to attend this trial. We cannot let them walk free! Joshua Molder, age 17, and brother Justin have been accused of Aggravated Cruelty to an animal and two other charges, and are currently jailed without bond. This petition, however, is focused on the Aggravated Cruelty charge. (See article below signatures.) We ask that the DA of Fulton County, Paul Howard or the attorney assigned to this case, aggressively seek indictment of a felony for this heinous criminal act based on the Anti-Cruelty Statutes of Georgia: 16-12-4. Cruelty to animals c) A person commits the offense of aggravated cruelty to animals when he or she knowingly and maliciously causes death or physical harm to an animal by rendering a part of such animal's body useless or by seriously disfiguring such animal. A person convicted of the offense of aggravated cruelty to animals shall be punished by imprisonment for not less than one nor more than five years, a fine not to exceed $15,000.00, or both, provided that any person who is convicted of a second or subsequent violation of this subsection shall be punished by imprisonment for not less than one nor more than five years, a fine not to exceed the amount provided by Code Section 17-10-8, or both. That is horrible. Some people are just sick. How could anyone do that to a puppy or any animal? I signed the petition.
