Can One Be Arrested On DUI If They Never Actually Start The Car?

What do you think? Is the intention to drive enough to arrest them on DUI or do they need to actually put the key in the ignition and start the car

I know in several states they will give a DUI even if you are in the car trying to sleep it off, they believe the intention was there to be able to drive. They could be just resting a few and then plan to drive type of thing. I don't think it should be that way. Yes maybe if they were trying to get the key in the ignition or looking like they were trying to drive the vehichle then I could understand it. However just being in the car itself doesn't mean you will drive drunk. I think that is assuming a great deal about the person. After all they could be sitting in there and listening to music while waiting for their ride to come get them. I think each case should be determined by what all is going on at the time. It's a judgement call and I can't blame the cops for making a call on the side to keep people safe.

Well.. unlike shop lifting , in which you have to actually leave the store with a concealed item before it's actual shoplifting, I could see where the mere intention to drink and drive could be a serious offense that was simply pre-empted.It's different from a lot of crimes and could possibly be an arrestable offense without cause and effect.

In India drunk drivers also get away with the crime. If you are a celebrity you get off even if you kill someone so no big deal is made if you are just sitting it out, though no onehere is so responsible to actually think of sitting it out or sleeping in the car if heis drunk. People will look at you in amazement if you tell them you slept in the cr because you are afraid to drive while drunk. well one of the vices of my country.

Each state is different and it depends on the officer.If you are sitting in your car and the key is not in the ignition then they can get you for public intoxication.And if you start to be a smart butt they can get you for a DUI or PI.Either way if you are intoxicated in public your going downtown.

I don't think you can be arrested for sitting in a car. I would rather someone sit in there car to sober up and sleep it off then be driving. My children don't need to be killed becasue of some crazy drunk, who says they aren't drunk.

well if you analyze it when it says you DUI you have to be really driving, if your your just sitting in the car, i think thats just sitting under the influence, lolz.. anyway intention is really hard to prove so its not enough to be arrested with...
