What age can kids choose where they want to live

My daughter doesn't want to live with her father and the judge is prejudicial because of I am spanish. She lived with me until she was 11 and her father came into her life because he settled down. According to the judge he had a more stable enviroment because he was married with a stay at home mom and I worked and was single. I was always home when she got home from school and my mom watched her whenever I needed her to. Which wasn't often. What really punches me in the gut is that my x did not want our son. Just my daughter. So they split up my kids. She wants to come home and is miserable. Her father is never home and is mean to her when he is.If anybody knows please let me know she is almost 13 now.

I think it depends on the state you live in...Your daughter has rights and I think you can get the decision reversed. My ex and I did an uncontested divorce (of 11 years) hard to believe huh--but we worked out everything that would be best for the kids. If I am not mistaken, I think there are certain laws in place that one parent cannot move out of state without the other parents permission. I know that is how it is here in New Mexico... I would love to help you research and get some paperwork together if you need some help.

That would be great. I live in PA and she is miserable and it breaks my heart to see her that way. Her grades are suffering and she is always crying that she doesn't want to go back. She is 12 and will be 13 soon. I wish he would consider her feelings.
