What do you do when your kid talks back?

I really want to raise my daughter to be assertive and feeling free to express herself - but sometimes she's so mouthy! I'm losing my temper more and more these days. She's 5. If she raises her voice thats automatic time out or spanking. I confess I do lose it and yell more than I should. How do you handle this?
