I have a 9 months old daughter that her biological father has never seen her. Do you know if he has any rights to her now. He has been convicted of violent acts and much more. Can anyone help me on this.

He has legal rights to her unless he decides to sign a statement giving up his rights or he is court ordered to give up his rights. It does suck but that is the law, at least it is where I live. You could go to court to have his rights taken away if you wish. I think all you have to do is file the papers with the court and then put an add in a local paper with the information about the court date so he has a chance to come in and fight the claim. If he doesn't show up then the claim goes through and he no longer has rights. I would say that if you really don't want him having anything to do with her then that is the way to go even though it will cost a little bit of money. Of course you could just let it go and not deal with it until or unless he shows up wanting to take her. Of course in order for him to take her he would have to go to court getting visitation rights. Talk to a lawyer. You can usually find one that gives free consultations and they would most likely be able to answer the questions you have and point you in the direction you need to be going. Good Luck.

I would contact legal aid in your community or a lawyer and ask these questions I think they have to SIGN away rights to the child before they are considered not having rights to the child. Legal aid should be free so good luck I hope you get the answers you are looking for.

By law he still has rights to his child unless he does something like giving up his parental rights and he would have to go to court for that. That is messed up that he hasnt seen his child since she has been born. You should go to CHILD SUPPORT and take it out on him if you have not already done so.You might want to get full custody of the child since he have those violent acts.

I think that if he want`s too he can get the child. He just need to see the judge and he can ask for his rights as her father.

He definately has rights as your babys father, but since he is a violent person,i think you should consider going to court to have full custody of your child,it will be better for your child if she is not exposed to violence at a very tender age,but PLEASE allow him access to his daughter IF he changes his ways.
