Should Microsoft remove the WGA check

Sometimes, when somebody celebrates his or her birthday they sometimes get software as a present. What if that software is in fact a copied original disk and the person does not have any experience with computers (just learning) would it be fair to let him or her pay even though he or she was given a present ?

I am refraining from using windows vista edition, as it is still in the beta version, and there may be a lot of bugs and errors in it. I would like to stick to my Windows XP for the time being.
