heirship in Texas

My daughter's grandmother died leaving my former husband executor. He never probated her will. She had a house in Austin, Texas that she wanted to leave to her four children or heirs. The eldest son died leaving 3 children, my former husband died, but the daughter (83) and middle son (75) are still living. The son had lived in the house but now needs a nursing home. The daughter wants to sell the house. How can we be sure that she will not try to cut out the dead son's heirs?
