child support

Am I able to take my ex-husband to court to revise on an order dated May 2001 for child support. At that time he was self-employed and had no paper trail. He started to work on the books [meaning he has now a paper trail] since March 2005. I am seeking to get child support arrears from May 2001-till current. He has done his taxes which were years behind and I'm also concerned as to what he claimed for child support as he contacted me to see if I would give him bogus receipts for child support which of course said no to. Am i able to take him to court to have this all revised as he has claimed his taxes and we would know his true amounts of monies that he made each year.

Yes and in the state of Calif they have a paper that you can use in court to make him go to work or go to jail and they should have given the IRS a heads up to take any money if and whenever he filed taxes. I am in the process of doning that now since my divorce is final. I hope you are able to get something out of him. Good luck

I have been going through all of this with my sister in law. I believe you can take him to court and get your back child support. as long as the court has proof of his wages they will be able to determine how much he has to pay. They did this with my brother, he owes 8000.00 back child support. He is doing everything he can to get out of it. There is now a warrant out for his arrest. If they pick him up he won't get out until someone can pay half of what he owes.

Once he is in the system, he is forever in the system. You want to go to your local child support agency and give them any information as to his whereabouts. And if he is in the the rears they will help you get it back...good luck to u

im not sure about in your state, but in my state u can have the child support payments reviewed for change every 3 years.. also for taxes, claiming the child support he didnt pay wouldnt do him any good.. since he still gets taxed on it and its no deduction or anything.. try calling your local child support agency and see what they can do for you! best of luck!

Yes Yes Yes! You definatley should request a review. They will take it back to court and look at his current earnings and order current support and a monthly payment for arrears owed. If he falls behind he can go to jail. I hate when people avoid child support...do they think the child is just gonna get by? Do they not realise how much they could improve the quality of life for their child...OHHHH this isse gets me going. Good Luck!
