Whose at fault?

I was backing into a pump to pump gas when another vehicle pulled in behind me (a "T" shaped accident)and I hit their car while they swiped the back of mine, whose at fault?

Typically when there is a rear-end collision, the car in the back is at fault.

Not true.. It would depend, in a parking lot BOTH persons are at fault, though I donno if gas pumps, would actually be concidered the parking lot...although if the other person had common sense you would think seeing someone backing up they would wait until the car has stopped to see if they could squeeze in too...

I am betting that they saw you backing in and tried to beat you to the pump! I would think that the other driver is at fault but Ohio law doesn't allow you to sue someone if it happens in a public parking lot.

Well if you live in Michigan, its nobody's fault. Great state (insert sarcasm here) When you filled out the accident report with the police officer what did the officer say?
