What would you do?

Okay so here's what happened (and this is a true story, because it JUST happened to me). I was working for a company through a temp service and I was there OVER my 90 days and was about to be hired in (reason I know that is because I filled out the "to be hired" paperwork a few weeks before this all took place), when I injured my back (my back was pretty bad, in fact, it still hurts even today as I sit here, this all just happened on January 22nd) no more than a week later I was FIRED because they said it was my "attendance" that caused this issue. But the REAL ISSUE was MY BACK!!! I was out a day and a half due to the doctor's note (which they saw EVERYTHING, and so did my temp service). My back would be hurting so bad, that when I took the pain pills (800mg of ibprofen) it didn't work! So I'd work at least 4-5 hours during the day and then I'd go home IN PAIN because I just couldn't take it ANYMORE! But it wasn't like I would intentionally leave for a stupid reason (and god knows there are plenty out there), it was because of my back. My doctor not only excused my day and a half of missed work, but he also put me on some major restrictions (no overhead lifting, no lifting over 20 pounds and there's few more). But after those limitations were put on me, I was pretty much worthless in their eyes. So on the 29th of January they fired me. They told my temp service it was because of my ATTENDANCE ISSUES (but here's my issue with this, right before Christmas last year I asked one of the supervisor's to pull up my record because I was curious as to what my points were, smart thing for me to do too! Anyways, he told me that I had 3/4 of a point and 1 error in my data entry department - which for being there 90 days it was a good record!) So now in a matter of 2 1/2 weeks how did I go to 10 points? In November I was out a whole week for being sick - had a doctor's note though! Also a whole week in December again I was out sick - but had a doctors note AGAIN! (so with 2 whole missed weeks of work, and having doctor's notes I only had 3/4 of a point, so how in the world did I get 10 points in 2 1/2 weeks?) Sorry, I'm just still so stunned and unsure of what happened to me. So if this were to happen to you, what would you do?

First of all, I'm sorry to hear you lost that job. I do think it's good that you work for a temp. agency as they will be able to find you another job. This might not be what you want to hear, but I do think your attendance probably was the cause. Even with a doc's note, you did miss a lot of days during a 90 day period. I have worked for the same corporation for 19 years, and we get 5 (FIVE) sick days each year. That's it!! Excused or unexcused. Anything over 5, you will not get paid and you will also be written up with a warning. I think the company you worked for was extremely liberal with your time off. Also, good luck with your back. I have a bad back, and I had a spinal fusion 3 years ago, and I'm doing great now, but I feel your pain!! Best of luck to you! :)

Well, no actually I got screwed with the temp agency, because they DIDN'T have anything for me once I was fired. I had to find my OWN job by myself, not saying that was bad, but yet it was. They (at the place I was working at) told me that if I was sick (which I truly was) and had a doctor's note excusing my absences then it wouldn't reflect on my attendance, but apparently something did. Because I had ALL my doctor's note, my temp agency had them as well and I got screwed at this job.

I've never worked for a temp agency, so I'm not sure as to how their guidelines work. But it sounds to me like you need to go to the labor board and ask them about how to deal with the situation. It just doesn't sound right what they did to you. Good luck with it. Keep us posted as to what happens.
