Lord of the Ring lawsuit

Apparently they promised to pay Tolkien estate a lot more than they have paid. But I wonder if the income calculation is correct, because if it is why wouldn't they pay the estate the right amount? Did the estate really attempt to reach them outside the court in the beginning, or they just decided to bring it to court intentionally to hurt the movie makers? Tell me what you think. I smell something fishy here.

To me it seems that it's New Line Cinema is dragging it's feet about paying any monetary gain and profits to the Tolkien estate, yet my question is, why did they, the Tolkien estate wait some five years after the last LOTR movie to file a lawsuit? If the estate saw that it wasn't being paid as the movies were drawing in mega bucks, they should have filed a lawsuit years ago, not now

that too. I mean how long does it say they have to wait for their full payment anyway? once the payment is overdue in a month they can certainly call to remind them, and maybe after so many failed attempts they should file but 5 yrs that's way too long
