What would you do if you found that the top district attorney (DA) of your county or province that prosecuted and sent several people to prison and the death row (and some wrongfully or on very flimsy evidence) is a drug addict, who is now defending charges against him by stating in his reluctant resignation letter that "... I have come to learn that the particular combination of drugs prescribed for me in the past has caused some impairment in my judgment"?
Under Texas law, an elected official can be removed from office on any of three grounds (all of which Harris County District Attorney Chuck Rosenthal is alleged to be guilty of):
1). Official misconduct,
2). Incompetency, and
3). Intoxication on or off duty.
With several wrongfully convicted people being released from prison after years of prison time, it certainly is of great concern to know that we have incompetent DAs trialing cases. One would expect the courts in Texas to be flooded at the moment by appeals!
