"anaesthetic awarenes"  | | how many of you have watched the movie "awake" starring jessica alba. in the start of ths movie the director has given some facts that are some persons who during their operation are not totally anaesthetic, they are awake but are paralyzed that means they cannot move not even a single part of their body but they know the process going on with them (might be of any organ transplantation as shown in the movie the transplantation of heart). they can feel the pain, hear voices of the doctors but cannot do or say anything to them... movies are movies.. but still they are based on real facts... i have'nt heard any sort of practical story, have anyone of you heard some sort of this thing. what will you say is it real.... beside all this i will recommend you to watch this movieeee.

The one drug that paralyzed her (I believe it is a curae type - but I could be mistaken) took effect but the pain killing one that normally "knocks you out" didn't. Basically she was awake and aware but completely paralyzed during the entire 3 1/2 hour operation. She brought a lawsuit against the hospital and the anaesthiologist (spelling???) and it ended up being settled out of court.

sherrylwatts (255) | 8 months ago | Settling out of court is where the two parties come to a cash arrangement without the intervention of a jury. The parties can set any terms they can both agree to - such as in this case, the hospital put a non-disclosure agreement on the amount the woman was paid. If they would have gone to trial, there was a chance the jury could have awarded her huge amounts of "pain and suffering" and "punitative damages" - costing the hospital millions of dollars. Like this, they pay her an undisclosed amount, she goes away and no more lawsuit.

sherrylwatts (255) | 8 months ago | No - in the US almost all (something like 85%) of lawsuits are settled out of court - it happens with everything from car accidents (insurance companies almost always have a policy to settle rather than go to court) to criminal charges (where a person is given a lower sentence for pleading guilty to a crime). The terms can be set by either side, but BOTH have to agree to them - if an agreement can not be reached, they go to court, where it can be a roll of the dice - just depends on who the jury finds more sympathetic.

sherrylwatts (255) | 8 months ago | Sorry - confusing - yes it is legal and even encouraged so as to not tie up the court system. Many judges will even get very harsh with two parties that can not reach a settlement agreement.
