Would you call this a scam?  |

|  I was faithfully clicking at nocturnalmail.biz for the past month and finally made the payout of only one buck.
This is when I can't find the withdrawal button so I wrote to their support and recieve no reply. So today I re-read their TOS and found a NEW clause that states that non-US members cannot ask for monetary payouts, only advertising credits.
Wow, I am beside myself with surprise. That clause was not there a month ago! They have like the most comprehensive TOS in the whole WWW! So I am very sure I have not seen that clause when I started clicking.
Well, you see, my point is, there is no way I can prove that clause wasn't in there in the beginning. And now after a month, I can't claim what was promised to me and frankly I am reluctant to say I am scammed but I am scammed, am I not?

| |  It sounds like you were scammed. If I were you I would drop out of that site. I personally won't be a member of a PTR site that doesn't pay.

| |  There was a misinterpretation of the TOS on the site as you can read below. Nocturnalemail is a paying site.

| | Whether it pays or not, I will never ever find out since the admin won't answer my emails and I have no way of proving that that clause wasn't there a month ago when I joined.

| |  I hate when that happens, and yes it is a form of scamming. I am a non US member also, and all too many sites do this to me too. Luckily now I am clicking on a few sites that do pay Uk memebers. I hope you have many more PTC sites and I suggest you forget about this one. Although when you have been scammed it makes you want to give them all up.

I said I have no way of proving that the clause wasn't there when I joined a month ago. I did not say I misinterpreted the TOS, and I can assure you I read TOS before joining any site. The reason being that I know that a lot of sites do not accept international members so I always make sure I do not click in vain.

May I suggest a correction and you read the TOS again. I am a member on Nocturnalmails and I live in Italy and have always been paid so far. After reading your discussion I checked the Tos on the site. I read thi:
No cash payouts will be made to members from the following countries: China, Hong Kong, India, Iran, Iraq, Malaysia, Pakistan, Singapore, Taiwan, Thailand, Vietnam. Members from these countries may redeem their earnings for advertising. There is no mention of non-US members.
I went to see if I can request my payout and the button IS there.
I hope you can see the difference between what you mentioned and what is actually stated on the site as people reading this who live outside USA, like me, could be tempted to cancel there membership without asserting the facts.
Nocturnalemail IS a paying site EXCEPT for those countries stated in their TOS. | | | | | | |

| |  I wonder if there was something in the original TOS that said that they could change the TOS at any time? Chances are, there was a clause saying that. For me, I would drop out of this program unless you can use those points for prizes that you might actually like.

I just got paid last night by the site owner which is very kind of him and lucky for me. Points for advertising just work for me since I was trying to get payment proof to help newbies along. | | | |
