Non-Smoking Apartments?

So we are in temporary housing while our house is being finished. We were lucky to find an apartment that took big dogs. The management is wonderful here but ugh, the people below us smoke SO much! There are 8 people living in a 2 bedroom apartment and they all smoke. It billows up into our apartment.
We said something to the management and they said they knew but that there was nothing they could do. We really weren't asking them to do anything I was just telling them for future residents that move in after us, they may want to consider putting smokers up here who don't mind it so much.
I was then informed that it is discrimination to seperate apartment buildings from smoking and non-smoking.
I was a smoker for many years and then quit for several years so I could get pregnant. I have never started again, nor will I. I never felt discriminated against. I felt as though it were my addiction and no one else should have to take part.
Smokers, with all the non-smoking things occuring, do you feel discrimated against?
Would you if you were told all the smoking apartment buildings were full and there was not an apartment available to you?
Non-smokers how do you feel about living in a place where you are a second-hand smoker not of your will in your own home because of a law?

I am a former smoker myself, and I'm shocked that they can't differentiate between smoking and non-smoking buildings (or at least group them within a quadrant). Even if it was something as simple as asking about smoking preference on the application (with an option for "prefer not to answer"), it might help. Or, maybe management could ask after the lease application process has finished and the person has been accepted, that way there is no risk of discrimination. I guess if they waited, though, they run the risk of not having a unit available if a smoking preference is given. That's a tough call.
As a side note, I'm surprised they let 8 people live in a 2 bedroom apartment.

I already reported the 8 people and management said they were aware. They said that they were told they had "guests"
I love guests too but not when they stay for months. Though I know it can happen, I have a hard time believing they are still just "guests". If I were that cramped, I would certainly try to find someone to go and stay with.
Then again, think of all the money they are saving on sucking second hand smoke, ha!
