| Hey friends, not long ago, there was a man that was bitten by a rattle snake at one of the stores. You might have heard of this on the news. Anyhow the man was bending down to pick up his baby's pacifier that had fallen on the ground. When he bent down the rattlesnake came out of the bushes and bit him. Now the rattlesnake was on the store property. Do you think that there are grounds for a lawsuit? Do you think that the owners of the store should be held liable? Tell me your thoughts on it. Thanks for sharing, Happy mylot! BTW, I think the man is doing okay, presently he just wants to get home to his wife and baby. | | Legally I think that the store could be held responsible, but I don't believe that it was really their fault. There's no way that they could've foreseen or prevented that from happening. Just sounds like some rotten luck to me. If I were in that guys shoes, I wouldn't try to press any charges against the store, unless perhaps I couldn't afford the doctor bill on my own. And really there would be no need to sue anyways, I bet if he wanted to just ask the store to pay for the doctor's bill, they probably would, just to keep customers and the general public happy and to avoid a lawsuit. | | I would only press charges if I had proof the rattlesnake was owned by the Store owner, or if the store was indeed a pet store. In my country, we have free medical car, so I wouldn't worry about not paying the bills. | | I don't believe in suing people, myself, so I wouldn't. He just might do it, though, and the store owners should be aware of this. People will do anything to get money these days. | | No, I don't think the store should be liable. Animals are animals, and they are hard to near impossible to control when we're not talking about the pet variety. Say I'm allergic to bees. I go in a store, but during the hours the store has been open, a bee came through the door when people were going in and out. If I get stung by the bee in that store, it isn't their fault if I go into shock because of my allergy to bees. Stuff happens. | | | | | | |

I mean the store owner had no way of knowing there would be a snake in the bushes unless he saw it or someone else did and told him, then he could call the proper people to handle it. But the sheer fact that there was a snake on his property doesn't hold him liable. I mean if the snake was on your property would you be held liable? I like how Ambie put it, if I get stung by a bee while at the store and need medical attention because I am deathly allergic to bees, it is not their fault it happened, no way to prevent nature from doing its thing. | | | |
